BIDDER ACKNOWLEDGES AND AGREES THAT ITEM IS SOLD TO THEM AS IS, WHERE IS WITH ALL FAULTS. THE CITY OF COLORADO SPRINGS/UTILITIES HEREBY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO. NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, DESIGN, CONDITION, CAPACITY, PERFORMANCE OR ANY OTHER ASPECT OF SAID ITEM. A PURCHASER OR DISAPPOINTED BIDDER SHALL HAVE NO RECOURSE AGAINST Colorado Springs Utilities/City of Colorado Springs, ANY OF ITS AGENCIES, OFFICERS, EMPLOYEES OR AGENTS.

Inspection:

• General condition and other available information regarding this item have been disclosed above.All items are described to the best of our ability, however many items come to us unknown.Any additional information would need to be obtained through bidder’s personal inspection of the item.
• Bidders arestrongly encouraged to inspect the property prior to submitting a bid.
• Inspections can be made by appointment only by contacting Investment Recovery (719) 668-7628.

Payment:

• Full payment is due within 7 calendar days after the auction's close.
• Buyer is responsible for paying the 8.25% sales tax over the final sale price. Unless it is for resale and buyer can provide us with a valid resale license or the item is a titled vehicle.
• Acceptable forms of payment are cashier’s checks made payable to the City of Colorado Springs, PayPal, and cash at time of pick-up.
• Payments can be accepted in-person or by regular mail.
• All sales are final.
• Failure to make payment or failure to remove the property, within the terms allowed, is considered breach of contract.In such an event, the Buyer shall lose all right, title, and interest which he/she might otherwise have acquired in and to such property as to which a default has occurred.
  

Loading and Removal of Property

• All purchases must be removed from the auction site within 14 days of the end of the auction unless other arrangements have been made.
• Shipping or the removal of property will be allowed only after full payment has been received by Seller.
• Unlessotherwise stated, buyer will make all arrangements and perform all work necessary to effect removal of the property.
• Buyer agrees to indemnify and hold harmless Seller for any and all damages, claims or liability for injuries to persons or property caused during the sale or by the removal of the item.
• Loading hours are 7:30-11:30AM and 12:30-2:45 PM, Monday-Friday, by appointment only. These hours exclude Colorado Springs Utilities observed holidays.

Damages

Unless otherwise stated, Seller will be responsible for the care and protection of the property subsequent to it being available for inspection and prior to its removal. Any loss, damage, or destruction occurring during such period will be adjusted at Sellers discretion not to exceed the original purchase price to the extent it was not caused directly or indirectly by the Buyer, its agents, or employees.
